1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding contract between you ("User", "Player", or "you") and Caki Games (Türkiye, referred to as "we", "us", or "our").

By downloading, installing, updating, or using any game, mobile application, virtual item, or web service provided by Caki Games (collectively, the "Services"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately uninstall and cease all use of our Services.

2. License Grant & Intellectual Property

Subject to your compliance with these Terms, Caki Games grants you a personal, non-exclusive, non-transferable, revocable, and limited license to access and play our games solely for your personal, non-commercial entertainment purposes.

• Ownership: All title, ownership rights, source code, visual assets, 3D models, graphics, audio, game design, logos, and trademarks (including "Caki Games" and "MMO11") are and remain the exclusive intellectual property of Caki Games and its licensors.
• Restrictions: You may not modify, distribute, copy, decompile, reverse engineer, disassemble, create derivative works from, or publicly exploit any part of our games without prior written permission from Caki Games.

3. Fair Play & Prohibited Conduct

We are dedicated to providing a fair, competitive, and enjoyable environment for all players. You expressly agree not to:

• Cheating & Exploits: Use cheats, automation software, bots, hacks, mods, macros, or any unauthorized software designed to modify, intercept, or automate game mechanics.
• Server Abuse & Attacks: Intercept, emulate, or redirect communication protocols between our game client and cloud servers; attempt denial-of-service (DDoS) attacks; or inject malicious payloads.
• Exploitation of Glitches: Exploit unintended gameplay bugs, currency duplication glitches, or economy errors. Any detected exploit must be reported immediately to [email protected].
• Account Trading & Real-Money Selling: Sell, rent, lease, trade, or transfer in-game accounts, clubs, players, or virtual currency for real-world currency ("RMT"). Any such transactions are void and will result in permanent bans of all involved accounts.
• Toxic Behavior & Harassment: Engage in abusive, hateful, vulgar, defamatory, discriminatory, or harassing conduct in club names, player names, or in-game chat.

4. Virtual Currency & In-Game Purchases

Our games may offer you the opportunity to license virtual items, virtual game coins, energy refills, or cosmetic goods ("Virtual Goods") using real currency via Google Play Billing or Apple App Store In-App Purchases:

• No Real-World Value: Virtual Goods have no monetary value, cannot be redeemed for real-world money, goods, or services from us or any other party, and do not constitute personal property.
• All Sales Final: All purchases of Virtual Goods are final and non-refundable, except as expressly required by applicable consumer law or the platform refund policies of Google LLC and Apple Inc.
• Pricing & Adjustments: Caki Games reserves the right to manage, regulate, adjust, or eliminate Virtual Goods and pricing balances at its sole discretion for game balancing and integrity.

5. Online Accounts & Cloud Data (MMO11)

In our persistent online multiplayer games such as MMO11:

• You are responsible for safeguarding your account credentials, device access, and login tokens.
• You agree to notify us immediately of any unauthorized use of your account.
• Caki Games is not liable for any loss resulting from unauthorized access caused by your failure to protect your login information or device security.

6. Account Termination & Suspension

Caki Games reserves the right, without prior notice or liability, to suspend, terminate, or delete any account or access to the Services if:

1. You breach any provision of these Terms or our community standards;
2. Our server anti-cheat or heuristic validation systems detect prohibited botting, memory editing, or packet manipulation;
3. Required by law enforcement or regulatory authorities;
4. An account has remained completely inactive for an extended period exceeding 12 months.

You may terminate your account at any time either through the in-game deletion option or via our Account Deletion Form.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Caki Games, its founder, contractors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, loss of data, loss of goodwill, device malfunction, or service interruption) arising out of or in connection with your access to or inability to use the Services.

In all events, the total aggregate liability of Caki Games for all claims arising under these Terms shall not exceed the amount actually paid by you to Caki Games in the six (6) months preceding the event giving rise to liability.

9. Governing Law & Dispute Resolution

These Terms and any dispute or claim arising out of or related to them shall be governed by and construed in accordance with the substantive laws of the Republic of Türkiye, without giving effect to any principles of conflicts of law.

You agree that any legal action, suit, or proceeding arising out of or relating to these Terms or the Services shall be instituted exclusively in the competent courts and enforcement offices of Gaziantep, Türkiye, and you submit to the personal jurisdiction of such courts.

10. Modifications to Terms

We may update or revise these Terms from time to time to reflect game updates, legislative changes, or server feature evolutions. Continued use of our games following the posting of updated Terms constitutes your acceptance of the revised Terms.
